What risk factors does nom-035-stps-2018 consider?
According to the Ministry ofLabor and Social Security (STPS) some of the factors that can cause psychosocial risks are:
- Workloads when they exceed the capacity of the worker.
- Working hours longer than those provided for in the Federal Labor Law.
- Shift rotation that includes a night shift without recovery and rest periods.
- Interference in the work-family relationship.
- Negative leadership.
- Negative relationships at work.
What should I implement according to the nom-035-stps-2018?
To avoid this type of risk, the law establishes a series of obligations, among which the following stand out:
- Establish and disseminate a psychosocial risk prevention policy in the workplace.
- Evaluate the organizational environment.
- Carry out medical examinations for workers exposed to workplace violence and / or psychosocial risk factors, when there are signs or symptoms that indicate any alteration to their health.
- Disseminate and provide information to workers.
Is there a deadline to COMPLY WITH NOM-035-STPS-2018?
It is important to highlight that the STPS contemplates the application of this standard in two stages:
- The first stage, which came into effect on October 23, 2019, consists of politics; prevention measures; the identification of workers exposed to severe traumatic events and the dissemination of information.
- The second stage, which will enter into force on October 23, 2020, consists of: the identification and analysis of psychosocial risk factors; the evaluation of the organizational environment; control measures and actions; the practice of medical examinations and records.

No, this obligation does not require payment of rights and benefits.
